These Terms govern your use of PrivacyScan (the "Service"), operated by PrivacyScan (the "Seller"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

PrivacyScan is an automated compliance scanner that inspects websites for HTTPS, cookie consent, privacy policies, PII exposure, and related controls, and produces a scored report mapped to regulations such as the NDPA 2023, GDPR, and GAID 2025. Reports are best-effort automated analyses and do not constitute legal advice.

2. Accounts

You must provide accurate information and are responsible for maintaining the confidentiality of your account credentials and all activity under your account. You must have the authority to bind any organisation you register on behalf of.

3. Acceptable Use

You must not (a) use the Service unlawfully, (b) commit fraud or spam, (c) infringe intellectual-property rights, (d) probe, scan, or otherwise interfere with the security of the Service, (e) upload malware, or (f) scan targets you are not authorised to test. You are responsible for ensuring you have permission to scan any URL you submit.

4. Intellectual Property

PrivacyScan and its underlying software, documentation, and branding are owned by the Seller. Subject to these Terms we grant you a limited, non-exclusive, non-transferable right to use the Service within your subscribed plan. You may not reverse-engineer, resell, or circumvent technical limits.

5. Payments, Subscriptions & Taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms. Subscriptions renew automatically at the end of each billing period unless cancelled.

6. Service Level

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation, and disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law.

7. Suspension & Termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations. On termination we will make a reasonable effort to allow you to export your data before deletion.

8. Liability

To the fullest extent permitted by law, our aggregate liability is capped at fees paid in the twelve months preceding the claim. We exclude liability for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited.

9. Indemnity

You will indemnify us against any claims arising from content you submit, unlawful use of the Service, or breach of these Terms.

10. Governing Law

These Terms are governed by the laws of the Seller's jurisdiction. Disputes are subject to the exclusive jurisdiction of the courts of that jurisdiction.

11. Changes

We may update these Terms. Material changes will be notified in-app. Continued use after changes constitutes acceptance.
